These Terms & Conditions (“Terms”) govern your purchase of products and services from our store, whether in-person, online at robscarpetservice.com, or over the phone. By placing an order or engaging our services, you agree to be bound by these Terms. Please read them carefully.1. General 1.1 Acceptance of Terms: All sales, services, and transactions are subject to these Terms. Any additional or conflicting terms provided by the customer are not binding unless agreed to in writing by us.
1.2 Modification: We reserve the right to update or modify these Terms at any time without prior notice. The most current version will be posted on our website at robscarpetservice.com. 2. Products and Pricing 2.1 Product Descriptions: We strive to ensure that all product descriptions, images, and specifications are accurate. However, we do not guarantee that all details are error-free. Colors, textures, and patterns may vary slightly due to manufacturing processes or display settings.
2.2 Pricing: All prices are in U.S. dollars and exclude applicable taxes, delivery, and installation fees unless otherwise stated. Prices are subject to change without notice.
2.3 Quotes: Price quotes are valid for 30 days unless otherwise specified. Custom orders or special-order items may require a deposit and are subject to additional terms.
2.4 Availability: Products are subject to availability. We reserve the right to substitute comparable products if an item is out of stock, with your approval. 3. Orders and Payment 3.1 Order Placement: Orders may be placed in person, online at robscarpetservice.com, or by phone at (203) 510-2016. All orders are subject to our acceptance.
3.2 Payment Terms: Full payment or a deposit (as specified) is required at the time of order. We accept cash, checks, and Zelle. Final payment is due upon delivery or completion of installation unless otherwise agreed.
3.3 Taxes: Connecticut sales tax will be applied to all applicable purchases as required by state law.
3.4 Financing: If financing is offered, terms are subject to the agreement with the financing provider. 4. Delivery and Installation 4.1 Delivery: Delivery times are estimates and subject to change. We are not liable for delays due to unforeseen circumstances (e.g., weather, supply chain issues). You must ensure access to the delivery location. Additional fees may apply for difficult access or special requests.
4.2 Installation: Installation services are provided by Robert Baerga Carpet Service . You are responsible for preparing the installation area (e.g., removing furniture, clearing debris) when specified. We are not liable for damage to property not caused by our negligence.
4.3 Inspection: You must inspect products upon delivery or installation. Any visible defects or issues must be reported within 48 hours of receipt. 5. Returns, Refunds, and Cancellations 5.1 Returns: Stock items may be returned within 14 days of purchase, provided they are unused, in original condition, and in original packaging. Custom or special-order items are non-returnable unless defective. A restocking fee of 15% may apply.
5.2 Refunds: Refunds for eligible returns will be processed within 10 business days to the original payment method. Delivery and installation fees are non-refundable.
5.3 Cancellations: Orders may be canceled before processing or delivery with written notice. Cancellations of custom or special-order items may incur a cancellation fee. 6. Warranties 6.1 Manufacturer Warranties: Products are covered by the manufacturer’s warranty, if applicable. Details are available upon request.
6.2 Installation Warranty: We provide a one-year warranty on installation workmanship, covering defects caused by improper installation. This does not cover normal wear and tear, misuse, or improper maintenance.
6.3 Disclaimer: Except as expressly stated, we disclaim all warranties, express or implied, including implied warranties of merchantability or fitness for a particular purpose, to the extent permitted by Connecticut law. 7. Care and Maintenance 7.1 Customer Responsibility: You are responsible for proper care and maintenance of carpet products per manufacturer guidelines. Failure to follow guidelines may void warranties.
8. Liability8.1 Limitation of Liability: To the fullest extent permitted by law, our liability is limited to the purchase price of the product or service. We are not liable for indirect, incidental, or consequential damages (e.g., loss of use, business interruption).
8.2 Property Damage: We are not responsible for damage to your property during delivery or installation unless caused by our negligence. 9. Governing Law and Dispute Resolution9.1 Governing Law: These Terms are governed by the laws of the State of Connecticut, without regard to conflict of law principles.
9.2 Disputes: Any disputes arising under these Terms shall be resolved through negotiation in good faith. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in New Haven County, Connecticut. 10. Force Majeure We are not liable for delays or failure to perform due to events beyond our control, including but not limited to natural disasters, labor disputes, or supply chain disruptions. 11.
